Terms

1. ACCEPTANCE OF ORDERS

1.1 All orders are accepted and fulfilled subject to these Terms and Conditions of sale unless otherwise varied in writing by a director of Thorogood Enterprises. All orders placed by the Customer shall be deemed to be placed in acceptance of these Terms and Conditions.

1.2 The receipt of our email order confirmation does not constitute the acceptance of an order, or as confirmation of an offer to sell as additional verification of information may be required prior to the acceptance of any order.

1.3 Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it in accordance with our instructions.

2. DISTANCE SELLING REGULATIONS

2.1 Under the Distance Selling Regulations you to have the right to cancel your order for any items purchased on our website or through our sales department and receive a refund. However this does not apply to goods where the seal or packaging has been broken. To cancel your order you must inform us as within seven days following the day of delivery of the goods.

2.2 Should you wish to exercise your rights under the Distance Selling Regulations your order may only be cancelled in writing, by fax or by e-mail as telephone cancellations cannot be accepted (Please quote your customer number and invoice number (if known) which can be found on delivery documentation).

2.3 You must take reasonable care of the goods and must not use them. You must return the goods to Thorogood Enterprises complete with all relevant packaging in an unused, unopened and re-saleable condition to us at your cost and we advise you to adequately insure the goods during any return journey and recommend a recorded delivery service.

2.4 Providing all return requirements have been met we will refund the purchase price of the items paid excluding Postage and Packaging within 30 days (Refunds will be processed using the payment method originally used to pay for the order).

2.5 Damaged goods will not be accepted therefore please ensure that the goods are adequate packaged and consult our returns procedure in section 6.0 for information.

2.6 The items must be returned within seven working days from the date we receive your cancellation. If you are unable to return the product to us within seven working you are deemed to be liable for the purchase.

3. DELIVERY

3.1 Our priority is to get your order to you as quickly as possible but we will not be liable to you for late delivery as we are dependent on our suppliers and couriers. We will notify you of estimated delivery dates when you order or in your order confirmation and although most goods will either arrive earlier or on the estimated date please allow 10 Working days for UK Mainland deliveries from approval of payment or receipt of Purchase Order number (‘Allowed Time’).

3.2 Items may be sent separately either by different methods or on different occasions but as your product is dispatched from our warehouse we will send you a despatch confirmation email to keep you informed of delivery progress.

3.3 Any time or date for delivery stated by the company should be treated as an estimate only, Whilst every effort will be made to dispatch goods on time no liability can be accepted by Thorogood Enterprises for failure to deliver within the advertised times. Thorogood Enterprises shall not be liable for any loss or damage whatsoever (including consequential loss or loss of profit) arising directly or indirectly from any delay in the delivery or any of the goods howsoever caused.

3.4 If we are unable to deliver within our usual delivery period (allowed time) we will place the items on our ‘Back Order List’ and dispatched as soon as possible.

3.5 Most delivery methods we use require a signature upon delivery and we therefore ask you to ensure that someone is present to sign for the goods.

3.6 Delivery discrepancies must be reported by email within 3 working days of delivery.

4.0 PAYMENT TERMS

4.1 Payment must be made in full before despatch of any goods by credit/debit card or postal order.

4.2 All invoices shall be paid in full, free from any deduction for any set-off, counterclaim or otherwise howsoever.

4.3 Credit Cards will be processed in full upon order placement by Thorogood Enterprises. However on occasions where goods cannot be supplied within the ‘allowed time’ and items are placed on the companies ‘back order list’ payments will usually be processed on the day the goods are received unless already processed.

5 PROPERTY TITLE

5.1 No property and title to goods shall pass from Thorogood Enterprises to the Customer unless and until the Customer has made full and complete payment to the Company of all sums due from the Customer in respect of the goods.

6. RETURNS

6.1 If you need to return an item due to a faulty product or incorrectly supplied items we will ask you to return the goods by an agreed method authorised in writing by Thorogood Enterprises. We will refund reasonable charges associated with the return of the items up to a maximum of £8.00 inc vat within 30 days of receipt of documentation (proof of posting receipt, payment receipt etc and detailing the invoice number).

7. PRICING

7.1 All prices quoted are in British pounds (£) and include Value Added Tax (VAT), the price you pay is the price displayed on our website or in our computer system at the time we receive your order.

7.2 Prices include standard mainland UK delivery for retail customers only, wholesale and overseas customers will be contacted separately with the relevant delivery charges and given the ability to then accept or cancel the order.

8. DAMAGED GOODS

8.1 Upon delivery of wholesale goods if you are unable to check the contents of the package immediately please mark the words ‘not checked’ clearly on the drivers documentation as failure to do so will prevent a claim for damages.

8.2 If the package appears damaged in any way or if there are signs that the package has been opened please endorse this on the drivers documentation.

9. VENDING MACHINE PRODUCT WARRANTY

9.1 Unless otherwise specified all new products are covered by a 12 months warranty from invoice date.

9.2 Thorogood Enterprises or its authorised agent will repair or replace any product that has failed in normal usage as long as the product has been used as intended and does not on examination display any signs of misuse (Usually an item will be replaced if a fault is reported within 14 days and repaired if reported after 14 days of invoice date however this will vary depending on the product.

9.3 If Thorogood Enterprises or its authorised agent attempts to repair a product and finds that no inherent manufacturing fault exists, Thorogood Enterprises will return the product to the customer and may charge to cover the cost of the inspection and testing process together with relating postage and packaging expenses including those associated with the collection and return of the product, These charges may be automatically charged to you credit/debit card.

9.4 The inspection and testing process of goods may take up to 28 days from receipt of the reported fault.

10. GENERAL

10.1 Email correspondence will be sent to the address provided by the customer when processing an order and we can therefore only respond to emails from that address.

10.2 The offering of products for sale by Thorogood Enterprises constitutes an invitation to treat and the right to decline orders or despatch to certain countries is reserved.

11. TECHNICAL SUPPORT

11.1 Technical support is only available after the purchase of a product and is only available to the original purchaser as recorded in our system and is not transferable

12. INCORRECTLY ORDERED ITEMS

12.1 We are not obliged to accept the return of a product unless covered by the Distance Selling Regulations as outlined in section 2 and you have notified us of cancellation in writing within 7 days of delivery, except where the an item is faulty.

12.2 We are entitled subject to our discretion to accept products that are unopened and unused subject to the deduction of a handling and administration fee of 20% with the cost of returning the items the customers responsibility.

13. UNDELIVERED GOODS

13.1 If any goods are returned by Royal Mail or any other carrier as either undelivered, uncollected, unknown address or refused they will be stored at our premises for a maximum of 6 months.

13.2 For each completed week that passes from the date of receipt a storage cost of £2.50 plus VAT will apply.

13.3 When goods have arrived at our premises in situations explained above the storage charges to date together with postage and packaging costs associated with the product will be payable in order to release the goods and re-attempt delivery.

13.4 Once the storage cost exceeds the value paid for the goods or after 6 months have elapsed ownership of the goods will transfer to Thorogood Enterprises and may be disposed of.
